I thought the same thing when I watched it again this morning, but I heard O'Neill saying about how it would be difficult to find a lawsuit to fit that situation....Maybe they felt it would be a too big security risk to fire him?

And besides, if Daniel left the show that early, it would have interfered with the entire "cast dynamic" thingy that centered around Jack and Daniel...just ask Robin to explain it to you LOL :D.

Deraliction of duty would have been enough. Like not following your supervisors directives (in the civilian world). But, I suppose for show purposes and the Stargate program itself, there would be other things to think about.
